General information from the CAPSIVERA editorial team – not individual tax advice, no liability assumed.
If you earn money as a creator in Germany, you must register a trade (Gewerbe) with your local trade office at the moment you start (§ 14 GewO) – there is no minimum income. Registration costs €26 in Cologne, and failing to register can be fined up to €1,000. Within one month you then submit the tax registration questionnaire to the tax office via ELSTER (§ 138 AO), after which you receive your tax number (Steuernummer).
When you have to register
The duty starts as soon as you work independently, on a repeated basis and with the aim of making a profit. Typical triggers are the first paid brand deal, switching on monetisation on YouTube or TikTok, a subscription page or the first affiliate link that earns commission.
German law sets no income threshold for registration. § 14 GewO requires notice "gleichzeitig" – at the same time as you start. Three other figures are often confused with a registration threshold. None of them exempts you from registering:
€12,348: the basic income tax allowance in 2026 – below it, no income tax.
€24,500: the trade tax allowance – below it, no trade tax (§ 11 GewStG).
€25,000 / €100,000: the small business VAT limits – below them, no VAT on domestic sales.
Influencers, streamers and subscription creators run a trade in almost all cases. Freelance status (freiberuflich, § 18 EStG) only applies to genuinely artistic or independent journalistic work. Freelancers do not register with the trade office; they only notify the tax office. Once advertising, product placements or affiliate links shape your content, tax authorities treat the activity as a trade. If you are unsure, registering a trade is the safer choice.
Before you start: permit, address and ELSTER
Three things save time if you are new to Germany.
Residence permit (non-EU citizens): Every residence title must state whether gainful activity is allowed (§ 4a AufenthG). Gainful activity includes self-employment (§ 2 Abs. 2 AufenthG). Check the wording on your permit or its supplementary sheet. If self-employment is not covered, ask the immigration office (Ausländerbehörde) before you start. Citizens of EU and EEA countries and Switzerland do not need a permit for this.
Registered address and Steuer-ID: After you register your address with the residents' office, the Federal Central Tax Office (BZSt) allocates your personal tax ID (Steuer-ID). It has 11 digits and stays the same for life. You need it for the tax questionnaire. If you have lost it, you can request it again from the BZSt; for data protection reasons it is only sent by post.
ELSTER account: ELSTER is the online portal of the German tax authorities. Register at elster.de as early as possible. Part of the activation data is sent to your address by post, which can take a while.
Step 1: Register your trade at the Gewerbeamt
The trade office (Gewerbeamt) of the municipality where your business is located is responsible. For creators without a studio, that is usually your home.
Fill in the form: In Cologne you can do this online through the Wirtschafts-Service-Portal NRW, and you receive your trade licence (Gewerbeschein) as a PDF straight away. Registering in person or by post also works. Avoid intermediary websites that charge extra fees.
Give your details: personal data, business address, start date, main or secondary occupation, and a description of your activity.
Pay the fee: €26 for individuals in Cologne, €33 for legal entities such as a GmbH. De-registering is free. Other cities set their own fees.
Wait for the data transfer: The trade office passes your data to the tax office and other bodies, including the chamber of commerce (IHK) (§ 14 Abs. 8 GewO).
Describing your activity
The description must be accurate but may be general. This matters because your name, business address and the registered activity may be made publicly accessible (§ 14 Abs. 5 GewO). Workable wordings are:
"Erstellung und Vermarktung digitaler Inhalte, Werbeleistungen über soziale Medien" (creating and marketing digital content, advertising services via social media)
"Erstellung und Vertrieb digitaler Medieninhalte über Online-Plattformen" (creating and distributing digital media content via online platforms)
The second wording also fits subscription platforms such as OnlyFans without highlighting adult content. If the trade office asks, answer truthfully. More on that in OnlyFans taxes in Germany.
Chamber of commerce (IHK)
As a trader you automatically become a member of the IHK. Individuals not entered in the commercial register pay no contribution as long as trade income does not exceed €5,200. Founders who had no business or self-employed income in the five previous years pay nothing in the founding year and the year after, and no levy in years three and four, if profit stays at or below €25,000 (§ 3 IHKG).
Step 2: The tax registration questionnaire in ELSTER
The trade office informs the tax office, but that does not replace your own registration. Within one month of starting, you submit the Fragebogen zur steuerlichen Erfassung (in German) electronically through ELSTER (§ 138 Abs. 1b and Abs. 4 AO). For a sole trader, choose the version for a sole proprietorship (Einzelunternehmen). The form is in German. These are the decisions that matter:
Question in the form | What it means for you |
|---|---|
Expected turnover and profit | The tax office uses your estimate to set prepayments. Too low means a large back payment later; too high ties up cash. |
Profit determination | Sole traders without bookkeeping duty use the cash-basis statement (Einnahmen-Überschuss-Rechnung). |
Small business regulation (Kleinunternehmerregelung) | Yes or no. Opting out binds you for at least five calendar years (§ 19 Abs. 3 UStG). |
VAT ID (USt-IdNr.) | Tick this if EU platforms pay you or you buy ads or software from EU companies. |
Bank account | Used for tax refunds. |
When estimating turnover for the small business question, count only taxable domestic sales. Payouts from foreign platforms usually do not count; see VAT for creators.
What arrives afterwards: your numbers in 2026
What | From whom | When / rule |
|---|---|---|
Trade licence (Gewerbeschein) | trade office | immediately with online registration in Cologne |
Tax number (Steuernummer) | your local tax office | after processing the questionnaire |
VAT ID (USt-IdNr., starts with DE) | Federal Central Tax Office | by post only; can also be requested online later with your Steuernummer |
IHK letter | chamber of commerce | membership notice; contribution-free within the limits above |
Prepayment notice (Vorauszahlungsbescheid) | tax office | based on your profit estimate; dates 10 March, June, September, December |
Your Steuernummer or USt-IdNr. must appear on every invoice. If you need the VAT ID later, the BZSt online form asks for your business details, your tax office and your Steuernummer.
Worked example: costs and taxes in the first year
Example: a creator who moved to Cologne in 2024 starts on 1 March 2026 with brand deals and platform income. She had no business income in the five previous years and earns a profit of €22,000 in 2026. She has no other income.
Item | Deadline | Amount |
|---|---|---|
Trade registration, City of Cologne | when starting | €26 |
Tax registration questionnaire (ELSTER) | within one month | €0 |
IHK contribution (founder, profit below €25,000) | – | €0 |
Trade tax (profit below €24,500 allowance) | – | €0 |
Income tax on €22,000 (basic scale 2026) | with the 2026 tax return | €2,072 |
Total costs and taxes 2026 | €2,098 | |
Maximum fine for not registering | – | up to €1,000 |
Income tax is calculated with the 2026 scale in § 32a EStG; no solidarity surcharge applies. If she also had a salary, the profit would be added to it and taxed at a higher rate. What changes at higher profits is explained in the guide to taxes for content creators.
Special cases
Registered late: Register immediately and state the actual start date. If income has already gone undeclared, clarify before contacting the tax office whether a correction or a voluntary disclosure is needed; what to look for in an advisor is covered in choosing a tax advisor as a creator. Late registration is an administrative offence with a fine of up to €1,000 (§ 146 GewO).
Creator teams: If two or more people run a channel together on joint account, each partner with authority to represent registers. The trade tax allowance applies once for the partnership.
Moving: If you move to another municipality, register there and de-register at the old address.
GmbH: A limited company registers its trade after it is entered in the commercial register; in Cologne this costs €33.
Minors: A minor may only run a business independently if the parents authorise it with approval of the family court (§ 112 BGB).
Common mistakes
Waiting for the "right" amount: There is no minimum. Registering a year later is registering late.
Wrong start date: The start is your first activity meant to continue, not the date you fill in the form.
Forgetting the questionnaire: The trade registration does not replace it. Without it you get no Steuernummer and your small business choice is not on file.
Activity described too narrowly: "YouTube videos" does not cover merch or coaching. If your activity grows, update the registration.
Assuming freelance status: Without clearly artistic or journalistic work, trade tax may be demanded later.
Ignoring your permit or employment contract: Check that your residence permit allows self-employment, and whether your employer must be told about a side business.
Mixing up the numbers: The Steuer-ID is personal, the Steuernummer is for your business file, the USt-IdNr. is for EU business.
Frequently asked questions
Do I need to register a Gewerbe for OnlyFans or Instagram in Germany?
Yes. Regularly earning money from content, brand deals or subscriptions is a trade, and § 14 GewO requires registration at the same time as you start. There is no minimum income. In Cologne registration costs €26 for individuals.
How much do I have to earn before registering a business as a creator in Germany?
Nothing – there is no minimum. The duty starts with your first activity meant to continue with profit intent, such as the first paid deal or switching on monetisation. Figures like €12,348, €24,500 or €25,000 only affect how much tax you pay, not whether you register.
What is the Fragebogen zur steuerlichen Erfassung?
It is the tax registration questionnaire you submit to the tax office via ELSTER within one month of starting (§ 138 AO). You estimate turnover and profit, choose whether to use the small business regulation and can request a VAT ID. Afterwards the tax office sends you your Steuernummer.
Can I register a business in Germany on a residence permit?
Every residence title must state whether gainful activity, which includes self-employment, is allowed (§ 4a AufenthG). Check your permit or its supplementary sheet, and ask the immigration office if self-employment is not covered. EU, EEA and Swiss citizens do not need a permit for this.
What should I write as my activity when registering as a creator?
The description must be accurate but can be general, for example "Erstellung und Vertrieb digitaler Medieninhalte über Online-Plattformen". Your name, business address and activity may be made publicly accessible (§ 14 Abs. 5 GewO). If the trade office asks for details, answer truthfully.
What happens if I register my business late?
Late or missing registration is an administrative offence with a fine of up to €1,000 (§ 146 GewO). Register immediately with the actual start date. If income has already gone undeclared, clarify first whether a correction or voluntary disclosure is needed.
